الملخص
الملخص الفتوى في النوازل الفقهية المعاصرة وأثرها على فقه الأسرة تشكل الأسرة اللبنة الأولى في بناء المجتمع والأمة، ولذلك أولى الشرع الحنيف هذا الجانب أهمية خاصّة ، ابتداءً من اختيار الزوجين لبعضهما ، حيث وضع المعايير والأسس التي يتمّ الاختيار وفقها ، ثم بيّن أهداف بناء الأسرة وتشكيلها ، وأهمية العناية بالنسل الناشئ عنها ، كما وضع الضوابط اللازمة لديمومتها واستمرارها واستقرارها . ومن هنا كان لا بدّ منإظهار بعض مقاصد الفتوى المتعلقة الأسرة ،و ضرورة إتباع منهج التيسير في الفتوى مع اعتبار الضوابط عندما يتعلق بفقه الأسرة ، وضرورة إدراك أهمية الفتوى في الحفاظ على الأسرة ومكانتها في النوازل الفقهية المعاصرة. وقد تمّ تناول البحث ضمن مبحثين : المبحث الأول: الفتوى وأهميتها : المبحث الثاني: ضوابط الفتوى ونماذج تطبيقية في النوازل الفقهية المعاصرة الخاتمة و تحوي أهم النتائج والتوصيات. The Fatwa of the Contemporary Jurisprudence Calamities and its Impact on the Jurisprudence of the Family Abstract The family is the first brick in the building of society and the nation. Therefore, this particular aspect is especially considered by Sharia law, starting from the choice of the spouses for each other, by setting the criteria and the bases for selecting each other, and considering thebjectives of building the family and its formation, For its permanence, continuity and stability. The first topic: Fatwa and its importance in three requirements: - The first requirement: the definition of fatwa and attributes language and terminology. The second requirement: the importance of the fatwa. The third requirement: the emergence of calamities develops, and their importance. The second topic: the rules of fatwa in contemporary jurisprudences and their impact on the jurisprudence of the family in three requirements: - The first requirement: the rules of the fatwa with the purposes of legitimacy in the calamities and their impact on the jurisprudence of the family.- The second requirement: the rules of the fatwa by facilitating the badges and their impact on the jurisprudence of the family.- Third requirement: controls change the fatwa by changing the customs and conditions in calamities and their impact on the jurisprudence of the family. The conclusion contains the most important findings and recommendations.
