أثر التوبة في إسقاط الحدود

الملخص
ليس خاف على من عرف الدين الإسلامي وخبره؛ أنه يتغيا تحقيق الصلاح وإقامة النظام في تصاريف تشريعاته ، وهو بذاك رحمة للعالمين، بيد أن الناظر في أفانين الأحكام قد يستشكل أمر المنظومة العقابية فيه، وخالها ناقض مقصد الرحمة والسماحة؛ لكنه يستبين موازنة راقية تروم تحقيق الصلاح بما لا يهدم مقصد الرحمة في توفيق بديع؛ ساعة علمه مبدأ التوبة وأثره في العقوبات إسقاطا؛ فجاءت هذه الدراسة في بيان أثر التوبة في إسقاط الحدود. أبان البحث في بدايته عن أهم مصطلحات الدراسة في المطلب الأول، ثم عرض إلى أثر الثوية في إسقاط الحدود المتعلقة حق الله تعالى في مطلبين اثنين؛ مفصلا پن وقوعها بعد وصول الأمر للقاضي وقبله؛ أن كان لذلك أثر في الحكم؛ فليست أحكام التوبة في إسقاط الحدود جسارة وحراءة على تعطيلها؛ بل هي بليغة في تحقيق مقصدها وهو الصلاح وانتظام الأمر في أبدع سبيلي وأضمنها، كما يتجلى في تفاصيل الموضوع. Abstract It is obvious that, Islam aims to achieve goodness and order through its legislations, this concept represents Islam as mercy to the world. However, looking to some Islamic rules that pertain to punishments may cause confusion as it seems to contradict compassion and forgiveness. Nevertheless, knowing the principle of Repentance, and its influence in Sanction waives emphasizes the fact that Islam is a mercy. In the first place, the researcher discussed the most important terms of the study, then he talked about the influence of repentance in Sanction waives related to Allah's rights, with special discussion about two cases, namely: before the judge knows about it and after he knows. Sanction waives does not mean underestimating hudud punishments but rather, it achieves a high objective which is reform.
