الملخص
شكل الغزو الامريكي للعراق سنة 2003 بكل ملابساته ونتائجه معاناة جديدة للشعب العراقي نتيجة الخروقات الخطيرة للقانون الدولي الانساني التي لازمته والمكيفة على انها جرائم حرب مست بكل المواثيق الدولية لحقوق الانسان خاصة المادة 08 من النظام الاساسي للمحكمة الجنائية الدولية ، الأمر الذي يستوجب ضرورة مساءلة الغازي وقواته وتوقيع العقوبة المناسبة على أفعالهم تحقيقا للعدالة الدولية . و ذلك بإجراء المحاكمات إما أمام المحكمة الجنائية الدولية ، وإما أمام القضاء الوطني سواء في العراق او حتى في الولايات المتحدة الامريكية ، مع مراعاة الجدية وتفادي المحاكمات الشكلية The American invasion of Iraq in 2003, with all its circumstances and consequences, constituted new suffering for the Iraqi people as a result of the grave breaches of international humanitarian law that were necessary and adapted as war crimes. It affected all international human rights treaties, especially Article 08 of the Statute of the International Criminal Court, which necessitates the necessity of holding Al-Ghazi and his forces accountable and signing Appropriate punishment for their actions in pursuit of international justice And by conducting trials either before the International Criminal Court, or before the national judiciary, whether in Iraq or even in the United States of America, taking into account the seriousness and avoiding formal trials
