الحماية الجنائية للبيئة من التلوث في التشريع العماني

الملخص
ملخص أصبحت البيئة محور اهتمام كافة الدول والمجتمعات الإنسانية، حيث أن تزايد النشاط الإنساني وتطور الحياة الاقتصادية لاسيما النشاط الصناعي أدى إلى ظهور العديد من المشكلات والظواهر البيئية الخطيرة لذا كان لابد من تدخلاً تشريعياً للحد من تلك الظواهر، وهو ما جعل سلطنة عمان تصدر العديد من القوانين واللوائح والقرارات الوزارية للحد من هذه المشكلات والعمل على الحفاظ على البيئة وحمايتها، وكما أن الإنسان هو الذي تسبب بسوء استخدامه في إحداث تلك المشكلات البيئية لذا كان لابد أن يتحمل المسئولية عن الأضرار بهذه البيئة وعما أحدثه من أنواع التلوث المختلفة بالبيئة فمسئولية الحفاظ على البيئة مسئولية مشتركة حيث يجب على كافة فئات المجتمع الإسهام في حلها ومن أهم الطرق لمكافحة خطر التلوث البيئي والحد من آثاره المدمرة الحلول التشريعية بصفة عامة والقواعد الجنائية منها بصفة خاصة. الكلمات المفتاحية: - البيئة؛ التلوث؛ الحماية الجنائية؛ القانون البيئي؛ عناصر البيئة. Abstract The environment has become the focus of attention of all countries and human societies, where the increasing human activity and the development of economic life, especially industrial activity led to the emergence of many serious environmental problems and phenomena. Therefore, it was necessary to intervene legislation to reduce these phenomena, which has made the Sultanate of Oman issued many laws, regulations and ministerial decisions to reduce these problems and work to preserve and protect the environment. Since it is the human being who has caused by its misuse these environmental problems, he must be responsible for the damage caused by them and for the various types of environmental pollution. The responsibility for the preservation of the environment is a shared responsibility and all sectors of society must contribute to its resolution. One of the most important ways to combat the threat of environmental pollution and reduce its devastating effects is legislative solutions in general and criminal rules.
