آليات استثمار الأملاك الوقفية في التشريع الجزائري

الملخص
لقد كان لمؤسسة الوقف دور فعال في المساهمة في صناعة الحضارة الإسلامية والنهضة الشاملة، وبقراءة لتاريخ الوقف نجد أنه شمل مختلف جوانب الحياة، من الجامعات والمستشفيات إلى الأوقاف الخاصة بالحيوانات كخيول الجهاد مثلا إلى أدق الأمور التي تخص الإنسان، في حياته الخاصة، وعليه فإنه من الضروري إعادة الاعتبار لدور الوقف وهذا يعني إعادة دور كبير للمؤسسات الناتجة عن أمواله خدمة للحضارة والتقدم وخدمة تنمية المجتمع و تطوره، ومن هنا لابد من الحفاظ على أموال الوقف، والحفاظ عليها يعني استثمارها حماية لهذه الأموال من الزوال مثل ما كان عليه الوضع في العهود الأولى لنشأة الوقف. أما في الوقت الراهن فإن موضوع تنمية الوقف واستثماره واجه مشاكل عديدة في كثير من الدول ومنها الجزائر، مما أثر سلبا على تنمية ممتلكاته، فمعظم الأموال الموقوفة من أراضي وعقارات غير مستثمرة مما جعل ويجعل لو بقي الحال على حاله شُحًا في أموال الوقف، ففي الجزائر وضع المشرع العديد من السبل و الطرق المقبولة شرعا وقانونا لتنمية هذه الأموال، وهو ما سيتم التطرق إلية في هذه الورقة البحثية. The waqf Foundation had an effective role in contributing to the manufacture of Islamic civilization and the overall renaissance. As for the time being, the subject of developing and investing the waqf has faced many problems in many countries, including Algeria, which negatively affected the development of its properties. Most of the funds that were suspended from lands and real estate are not invested, which made and makes if the situation remains the same in the endowment funds, in Algeria he put The legislator has many legal ways and methods to develop these funds, which will be discussed in this research paper.
