النسبية في العدول وفق مسوغاته الشرعية من خلال أصل مراعاة الخلاف

الملخص
فعدول المجتهد عن دليله إلى دليل غيره ، كان مربط حجة من أنكر أصل مراعاة الخلاف من المالكية على القائلين به منهم، فعدوا العدول، احد أدلتهم للعدول عن القول بهذا الأصل، فلأجل ذلك حاولنا الوقوف على حقيقة هذا العدول ، أن كان حقيقيا أم نسبيا، فعززنا المقال بالمسوغات التي أملت على المجتهد الانتقال من دليله إلى دليل غيره، وفق أصل مراعاة الخلاف، لنخلص في محصلة مفادها ان العدول كان نسبيا، لان المجتهد لم ينتقل إلى دليل غيره مجردا بل أملت أدلة أخرى معتبرة عنده لفت نظره عن دليله إلى دليل المخالف ممتطيا أصل المراعاة كدليل يسبح في فلكه، مما جعل هذا العدول النسبي مزية زينت احد أصول المذهب، فأصبغت عليه وصف المرونة، لان تلك الاستطالة لم تكن بمعزل عن أصل شرعي معتبر بل كانت امتداد له اعتبارا لأدلة أخرى معتبرة رجحت دليل المخالف بعد تغير صورة المسألة، فيتشكل في آخر المطاف مسألتين، لكل صورتها مما يستدعي ذلك نظرا مخالفا، قد يقتضي عدولا عن الدليل الأصلي، لكنه في حقيقة الأمر عدولا نسبيا، لان الدليل الأصلي تغيرت صورة مسألته بعد الوقوع. Abstract : Praise be to Allah alone and prayers and peace be upon those who have no prophet after him, and after: Al-Mujtahd changed his evidence to the evidence of others. He was an argumentator who denied the origin of the dispute from the Maalikis on those who say it to them. We tried to find out the truth of this decline, whether it was real or relative, so we reinforced the article by the rationales that dictated to the Mujtahid to move from his evidence to the evidence of others, according to the origin of the dispute, to conclude in the conclusion that the conversion was relative, He had hoped for other evidence in which he had drawn his evidence of the violator's manual He said that this elongation was not in isolation from a legitimate origin, but was an extension of it to the effect of other evidence, considering the evidence of the violator after changing the picture of the matter, Vichkel In the end, two issues, each of which requires a different perspective, may require an alternative to the original evidence, but in fact it is relatively far-fetched, because the original evidence changed the picture of its issue after it occurred.
