كيفيات استغلال العقارات الوقفية الموجهة لانجاز مشاريع استثمارية

الملخص
يهدف هذا المقال للبحث عن كيفيات استغلال العقارات الوقفية العامة المبنية أو غير المبنية الموجهة لانجاز مشاريع استثمارية و الواقعة في قطاعات معمرة أو قابلة للتعمير كما هو محدد في أدوات التهيئة و التعمير المنصوص عليها في القانون 90-29 المتضمن قانون التهيئة و التعمير. حيث تعتبر عقود استغلال العقارات الوقفية الموجهة لانجاز مشاريع استثمارية من أهم العقود الادارية التي ستبرمها السلطة المكلفة بالأوقاف نظرا لأهميتها البالغة في تثمين و تنمية الوقف . و مسايرة للتطورات الاقتصادية و للمنظومة القانونية حرص المشرع الجزائري في المرسوم التنفيذي 18-213 على فتح باب التنافس بين مختلف المستثمرين و تسهيل اجراءات ابرام عقود استغلال العقارات الوقفية العامة الموجهة لانجاز مشاريع استثمارية عن طريق طلب العروض كقاعدة عامة أو بالتراضي في الحالة الاستثنائية. Abstract: This article aims to study the method for the exploiting wakfs real estate built or inbuilt ,oriented for the realization of investment projects located in the urbanized or urbanizable sectors, as defined in the amenagement and urban instrument stated in the law N90-29 included the edited and complement urban planning and development law . the exploiting wakfs real estate oriented for the realization of investment projects are considered as the most important administrative contracts which the wakfs authority concluded regarding its high interest in the valuation and the development of the wakfs ,to be in accordance with the economic development and the legal system, the Algerian legislature keens in Executive Decree No 18-213 to open the way for the competition between different investors and facilitate the procedures of concluding the contracts of the exploiting public oriented real estate wakfs for the realization of investment projects . by requesting submissions as a general rule or by way of OTC
