خصوصية الإيجاب و القبول في العقد الإلكتروني

الملخص
يشهد هذا العصر ثورة تكنولوجية لم يسبق لها مثيل، صاحبها تطور كبير و متسارع في شبكة الاتصال، و التي أحدثت تغيرا هاما في عملية التواصل بين الأشخاص، و على الأخص في طريقة إبرام العقود، حيث أصبحت هذه الأخيرة تتم دون الحضور المادي لطرفي العقد، فظهر ما يسمى بالعقد الإلكتروني. و العقد الإلكتروني شأنه شأن العقد التقليدي، ينعقد بتراضي طرفيه حول جميع المسائل الجوهرية لانعقاده، وذلك بتطابق الإيجاب و القبول، غير أن التعبير الإلكتروني عن الإرادة جعل للإيجاب و القبول خصوصية يتميز بها، تنبع أساسا من الوسيلة المستخدمة في التعبير عنهما. This era is witnessing a technological revolution that has never been seen before, accompanied with a huge and an accelerating evolution in the network, that caused an important change in the communication field , especially in the way of signing contracts that are now made without the physical presence of both sides, for which resulted the appearance of the electronic contract. The electronic contract same as the traditional one , is held by mutual agreement on all the important matters ,by positive matching and acceptance , however, the electronic expression of will has made a special quality for the answers and agreements , that comes mainly from the means used to express them. Notre époque connait une grande révolution technologique qui a eu pour effet le changement dans le processus de communication, surtout au sujet des contrats car ces derniers peuvent être conclus même si les personnes qui font partie de contrat sont absentes; dans ce cas là , le contrat est appelé "contrat électronique". Tout comme le contrat classique, le contrat électronique est conclus d'un commun accord qui correspond à l'offre et l'acceptation. Cependant, ces derniers sont caractérisés ; selon l'expression électronique de la volonté ; par les moyens utilisé pour l'exprimer.
