الدفع بسبق الفصل في الدعوى بنظام المرافعات السعودي والمصري دراسة تحليلية مقارنة

الملخص
المستخلص ان بعض الخصوم يصدر له حكم قضائي لا يقنعه بما قضى به، فيقوم بإعادة رفع الدعوى إلى القضاء بصيغة أخرى حتى يكتسب أكبر قدر من المزايا في موضوع دعواه. الا أن الأمر ليس بالهين السهل على القضاء أن ينظر القاضي في ذات الموضوع. وعليه كان الدفع بسبق الفصل في الدعوى من الدفوع التي يجوز للمحكمة الحكم بها من تلقاء نفسها، وفي أي مرحلة كانت عليها الدعوى. واتجه البحث إلى بيان ماهية هذا الدفع، والتدقيق في ضوابطه القانونية التي وردت بالنص القانوني في نظام المرافعات السعودي وقانون المرافعات المصري بمنهج وصفي تحليلي. وتوصل البحث إلى عدة نتائج أهمها أن الحكم بإلغاء حكم سابق بعدم قبول الدعوى لسبق الفصل فيها يصلح معه إعادة النظر في الدعوى. الكلمات المفتاحية: الخصوم- الدعوى- الدفوع- سبق الفصل في الدعوى- وحدة الموضوع-السبب-المحل Abstract: Some litigants issue a ruling that does not convince him of what he decided, so he resubmits the lawsuit to the court in another form so that he can gain the greatest amount of advantages in the subject of his lawsuit. However, it is not an easy matter for the judiciary to consider the same matter. Accordingly, the defense that the case was previously decided was one of the defenses that the court may rule on its own initiative, at whatever stage the case was. The research was directed to clarifying the nature of this payment, and examining its legal controls contained in the legal text in the Saudi pleading system and the Egyptian pleading law, using a descriptive and analytical approach.
