صور حماية الأراضي الفلاحية في التشريع الجزائري

الملخص
تشكل الأراضي الفلاحية مصدرا أساسيا للثروة و النهوض بالإقتصاد الوطني ،وأحد الركائز الأساسية للإستثمار لذا فقد دأب المشرع الجزائري على سن القوانين و المراسيم التنفيذية المنظمة لعملية استغلال هذه الأراضي كما أحاط عملية استغلال هذه الأراضي بمجموعة من القيود و الضوابط قد تصل لحد الحرمان من الملكية وذلك من أجل المحافظة على طبيعة ووجهةالأراضي الفلاحية وقد إتخذ في سبيل تحقيق هذا الهدف مجموعة من الأدوات القانونية التي تخول له سلطة مراقية استغلال الأراضي الفلاحية التابعة للأملاك الوطنية الخاصة منها ما يتعلق بالرخص الإدارية المتطلبة قانونا ، وكذا الشروط المتطلبة من أجل تجزئة الأراضي الفلاحية ، و إرساء مجموعة من الشروط المتعلقة بتجميع الملكية الفلاحية، إذ يحقق استثمار الأراضي الفلاحية كوحدة عقارية متكاملة وسيلة هامة في تحقيق الأرباح و التنمية الإقتصادية،في حين يشكل تفتيت الملكية الفلاحية و تحويلها إلى أرض عمرانية بإنشاء التحاصيص عليها ضربة قاضية للعقار الفلاحي.لذا سنتطرق من خلال هذه الورقة البحثية إلى تحديد مفهوم الأراضي الفلاحية و تحديد طبيعة المعاملات و التصرفات الواردة عليها ، و كيفيات تدخل الدولة لحمايتها من خلال ضبط شروط استغلالها وضمان عدم تحويلها بتجزئها و البناء عليها و نتطرق أيضا لشروط تجميع ملكية الأراضي الفلاحية الصغيرة لتحقيق الإستغلال الأمثل لها. ABSTRACT The agricultural lands are an essential source of wealth and the promotion of the national economy, and one of the main pillars of investment. Therefore, the Algerian legislator has enacted laws and executive decrees regulating the exploitation of these lands. In order to preserve the nature of the agricultural lands and has taken in order to achieve this goal a set of tools, which gives him the power to watch the exploitation of farmland belonging to the national private property, including with respect to administrative licenses required by law, as well as evil In order to divide the agricultural land and establish a set of conditions related to the collection of agricultural property, the investment of agricultural lands as an integrated real estate unit is an important means of achieving profits and economic development. The fragmentation of agricultural property and its transformation into urban land, Judge of agricultural real estate. In this paper, we will examine the definition of agricultural land, determine the nature of the transactions and the actions taken on them, and the ways in which the state intervenes to protect them by controlling the conditions of their exploitation and ensuring that they are not diverted and built on them. .
